CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA OF EMPLOYEE CANDIDATES AND PEOPLE WHO REFERENCE THE EMPLOYEE CANDIDATES WITHIN THE SCOPE OF RECRUITMENT PROCESSES

1. Data Controller

Your personal information is held by the Babaeski Trade Registry Office, under registration number 1954, with the company headquarters situated at Köy Sok. Vardar Tarım Ürünleri Sanayii ve Ticaret Limited Şirketi (“Company”), located at 192 A Karamesutlu Köyü Babaeski/Kırklareli, is accountable for the recruitment of Employee Candidates and Persons Referring to Employee Candidates in accordance with the regulations of the Personal Data Protection Law No. 6698 (“KVKK”) and the associated Recruitment Process. This data is managed following the guidelines outlined in the Information Text concerning the Processing of Personal Data.

2. Method of Collection of Your Personal Data and Legal Reasons for Processing

Personal data may be collected by our company through various means such as job application forms, interviews, emails, and communication tools on our website, utilizing electronic and/or physical media, whether automated or non-automated, as long as it is part of a data recording system. This collection is directly linked to the establishment or execution of a contract as outlined in Article 5 of the KVKK. Processing of personal data is essential for contract parties, legitimate interests of the data controller without infringing on the rights of the individual, fulfillment of legal obligations, and for the establishment, exercise, or defense of legal claims. Explicit consent is required for personal data processing within the framework of legal regulations.

3. Your Processed Personal Data Categories and Purposes of Processing Your Personal Data

Job applications are received in accordance with the personal data processing conditions outlined in Article 5 of the KVKK. This includes conducting suitability assessments, organizing interviews, finalizing applications, and managing the selection and placement of candidates. Personal data categories processed cover communication, management, human resources planning, performance evaluation, and, with explicit consent, CV evaluation for current or future positions within the Company. Details regarding the processing purposes of personal data are provided below.

4. Transfer of Your Personal Data to Third Parties Domestically 

Within our organization, employees with restricted access authorization can only access your personal data to the extent required to fulfill their duties for the specified purposes.

On the contrary, your personal information within the aforementioned categories and special categories of personal data may be processed, as long as it is explicitly outlined in the regulations specified in Article 8 of the KVKK and is closely linked to the formation or implementation of a contract. Explicit consent is deemed a prerequisite for the processing of personal data (legal grounds) when it is essential for the processing of data to be legally binding, when data processing is necessary for the establishment, exercise, or defense of a right, and when data processing is necessary for the legitimate interests of the data controller, ensuring it does not infringe upon the fundamental rights and freedoms of the individual concerned.

  • To our suppliers, business partners, and employees for the purpose of evaluating employee candidate profiles, conducting personality inventory and professional qualification tests, planning and organizing trainings, hosting data, and providing similar services for job application processes. This includes human resources, social security, and legal consultants, personality inventory and training service providers, organization companies, call center suppliers, and information technologies and data hosting service providers for managing participation in interviews, trainings, and tests.

  • To the individuals you designate as references for the purpose of reference checking, and

  • It can be transferred to legally authorized entities and individuals for fulfilling our company's legal obligations, promoting employment, enjoying other rights, and monitoring legal matters.

5. Processing Period of Your Personal Data

Your personal data collected during our company's operations are stored in compliance with the overarching principles and regulations outlined in our company's policies and procedures concerning storage and disposal, crafted in alignment with the Constitution, KVKK, the Regulation on Deletion, Destruction, or Anonymization of Personal Data, and other pertinent legislation, and subsequently eradicated.

 

In this scenario, the erasure of your personal data will occur once all the personal data processing requirements outlined in Article 5 of the KVKK are met. If you are hired, your personal data gathered during your job application and candidacy will be processed throughout the duration of the employment contract and subsequent legal limitation periods. If you are not hired, your data will be handled as follows: (a) without your explicit consent, it will be deleted after the trial period for the position ends; (b) with your explicit consent, it will be deleted upon acquisition for the purpose of assessment for current or future positions within our Company, as per your consent, and for other specified purposes in your consent. This processing will persist for 2 (two) years. Furthermore, your personal data from the information and documents related to the evaluation processes conducted by our Company concerning your job application will be retained for the general statute of limitations for legal actions to safeguard our defense rights in case of potential disputes, even if you are not hired, following the general principles established in the relevant legislation. Concerning requests for the deletion of your personal data, we kindly direct you to the 6th section of this Information Text.

6. Your Rights Under KVKK

We hereby inform you that, as a personal data owner, you have the following rights in accordance with Article 11 of the KVKK:

 

  • Determining whether your personal data is being processed,

  • Request for confirmation of the processing of your personal data.

  • Understanding the purpose of processing personal data and ensuring its intended use.

  • Being aware of the third parties to whom your personal data is transferred domestically or internationally,

  • Requesting the correction of personal data if it has been processed incorrectly or incompletely, and requesting that any actions taken in this regard be communicated to third parties to whom the personal data has been disclosed.

  • Requesting the erasure or destruction of personal data if the reasons for processing no longer exist, even if it was processed lawfully, and notifying third parties of any incomplete or inaccurate data processing.

  • Objecting to the emergence of unfavorable results for individuals by solely analyzing processed data through automated systems is crucial.

  • Request compensation for damages resulting from unauthorized processing of your personal data.

 

Applications concerning your aforementioned rights can be submitted to the Data Controller following the guidelines outlined in the Communiqué on Application Procedures and Principles. This can be done in writing, through a registered email (KEP) address, secure electronic signature, mobile signature, or a previously provided email address registered in our systems. To verify your identity as the rightful owner, you are required to submit relevant information/documents electronically (such as T.R. ID number or passport number for non-citizens, contact details, and email address). You can complete the Relevant Person Application Form available on www.vardarticaret.com or submit it to our Company through the specified channels. Your requests will be processed promptly and at no cost, with a maximum timeframe of 30 days. Additional charges may apply if the process necessitates it, as per the tariff set by the Personal Data Protection Board.
